According to us, the missing slur over the top voice is Chopin's inadvertence: in the further part of this phrase, corresponding slurs are already present. Due to the above reason, in the main text we suggest adding the slur after b. 5 and 13. EE added the slur in the 2nd half of the bar, probably after b. 37.
